Agreement to Terms

By accessing or using the services of OEVER.ART ("we," "our," or "us"), you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use our services.

Services

OEVER.ART provides custom digital portrait creation and fine art printing services. Our services include:

• Hyper-realistic digital portrait creation
• Museum-grade fine art printing
• Hand-signing and certificate of authenticity
• Worldwide shipping

Commission Process

Submission

To begin a commission, you must complete our commission form with accurate information and provide clear reference photographs. Minimum requirements include:

• Front-facing photograph
• Left and right profile photographs
• Full body photograph

Review and Confirmation

We will review your submission within 24-48 hours and provide:

• Confirmation of project feasibility
• Final pricing quote
• Estimated timeline
• Payment instructions

Payment

A 50% deposit is required to begin work. The remaining 50% is due upon completion and before final delivery. We accept bank transfer, credit card, and PayPal.

Revisions

Each package includes a specified number of revision rounds:

• Digital Only: 2 revision rounds
• Digital + Museum Print: 3 revision rounds
• Complete Collection: Unlimited revisions

Revisions cover adjustments to likeness, colors, and composition. Major changes to the original concept may incur additional fees.

Delivery

Digital Files

Digital files are delivered via secure download link in TIFF format at 8K resolution. Files must be downloaded within 30 days of delivery.

Physical Prints

Prints are carefully packaged and shipped via insured courier. Delivery times vary by destination. Risk of loss transfers upon delivery to the shipping address provided.

Intellectual Property

Your Rights

Upon full payment, you receive:

• A personal use license for the digital file
• The right to make personal prints
• The physical print (if ordered)

Our Rights

We retain:

• The right to display the artwork in our portfolio (unless otherwise agreed)
• The right to use the artwork for promotional purposes (with your consent)
• All rights not explicitly granted to you

Commercial Use

Commercial use licenses are available for an additional fee. Contact us for commercial licensing inquiries.

Cancellation and Refunds

Before Work Begins

If you cancel before work begins, you will receive a full refund of your deposit.

During Creation

If you cancel during the creation process:

• Before first review: 75% refund
• After first review: 50% refund
• After final approval: No refund

Satisfaction Guarantee

If after all included revisions you are not satisfied, we offer:

• A complete restart with a new artist at no additional cost, OR
• A 50% refund if you choose not to continue

Privacy

Your privacy is important to us. All reference photographs are:

• Used solely for creating your portrait
• Stored securely
• Permanently deleted after project completion
• Never shared or sold

Limitation of Liability

To the maximum extent permitted by law, OEVER.ART shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from or related to our services.

Warranty

We warrant that:

• All work will be performed in a professional manner
• Prints will be free from defects in materials and workmanship
• Colors will be matched to approved digital proofs

This warranty does not cover damage caused by improper handling, display, or storage.

Governing Law

These Terms shall be governed by and construed in accordance with the laws of the Netherlands. Any disputes shall be resolved in the courts of Amsterdam.

Changes to Terms

We reserve the right to modify these Terms at any time. Changes will be effective immediately upon posting to our website. Your continued use of our services constitutes acceptance of the modified Terms.
